1. Acceptance of Terms
By downloading, installing, or using the Better Backgammon mobile application (the "App") or accessing our website at betterbackgammon.com (together, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Service.
The Service is operated by Better Backgammon, a company based in the United States.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Account Registration
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use.
4. Use of the Service
The Service provides backgammon training through interactive drills, equity analysis, AI coaching, and progress tracking. You agree to use the Service only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Attempt to reverse-engineer, decompile, or disassemble the App
- Interfere with or disrupt the Service or its infrastructure
- Access accounts or data belonging to other users without authorization
- Use automated tools or bots to interact with the Service
- Redistribute, resell, or sublicense the Service or its content
5. AI Coaching Feature
The App includes an AI-powered coaching feature. This feature provides backgammon guidance and analysis for educational purposes only. AI-generated coaching is not a substitute for professional instruction and may occasionally contain inaccuracies. We do not guarantee the accuracy or completeness of AI-generated content.
6. Intellectual Property
The Service, including all content, features, design, code, trademarks, and training materials, is owned by Better Backgammon or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
Backgammon position data and equity analysis are derived from GNU Backgammon, which is distributed under the GNU General Public License. Our use complies with applicable open-source license terms.
7. In-App Purchases and Subscriptions
Certain features may be available through in-app purchases or subscriptions processed by the Apple App Store. All purchases are subject to Apple's terms and conditions. Refund requests should be directed to Apple.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your device's App Store settings.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific learning outcomes or improvement in backgammon skill.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTER BACKGAMMON SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.
11. Indemnification
You agree to indemnify and hold harmless Better Backgammon, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with or without notice. You may terminate your account at any time by contacting us at support@betterbackgammon.com.
13. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
For claims under $10,000, arbitration may be conducted entirely online. Either party may seek injunctive relief in any court of competent jurisdiction.
14. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms within the App or on our website and updating the "Effective Date." Your continued use of the Service after changes constitutes acceptance of the updated Terms.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
